Obtain a Trademark
We can assist with conducting due diligence on your proposed marks, and assist with preparing and prosecuting your trademark application before the USPTO. We will identify the proper classification and goods/services applicable to your mark. We assist clients with trademark filings in the United States, as well as in Europe and other parts of the world through our affiliate network of attorneys.
Registering your trademarks is an important step in establishing priority and enforceable rights, and can drastically improve your odds in a domain dispute proceeding.
Trademark Opposition Proceedings and Cancellation Proceedings
An opposition is a proceeding in which one party is seeking to prevent registration of another party’s trademark. Under the law, if a party believes that he will be damaged by the registration of a mark, they can file an opposition.
A cancellation is a proceeding in which a party seeks to cancel an existing registration of a mark. Under the law, a person who believes he will be damaged by the registration may file a petition to cancel.
We assist both plaintiffs and defendants in trademark opposition and cancellation before the United States Patent and Trademark Office’s Trademark and Appeal Board (TTAB).
We provide a complete range of trademark enforcement services in addition to the UDRP process, including under the Anticybersquatting Consumer Protection Act (ACPA). We will work with you to develop an aggressive trademark enforcement strategy while mitigating risks and costs. We have assisted clients with trademark, trade dress, unfair competition, false advertising, and counterfeit/grey market issues.
Our enforcement strategy typically involves attempting to reach a favorable outcome without resorting to litigation. However, if litigation is required, we will aggressively represent you to defend your trademark rights.
